Terms of Service of GIRL'S BLUE

Article 1 (General)

1.The HAPYY FISH users is subject to Terms of Service of HAPPY FISH. The HAPYY FISH users have the responsibility to obey the Terms of Service of HAPPY FISH.

Article 2 (About modifications and changes of the Terms of Service)

1.Terms of Service are applicable to the program users. Members should observe the Terms of Service.
2.The program is authorized to change its content of price and terms of service without consent of the members’. When this program modifications and changes are listed on the web, as well as inform Emails being sent to subscribers, they have the binding force of the subscribers and shall become effective.
3.Agreement on matters not listed in this program is giving priority to the program to modify and change. This is considered as a part of the Terms of Service.

Article 3 (Member)

1.People under 18 years of age can not apply to a member.
2.Only members themselves can use the service.
3.Services provided by this program (except for some free services) will be available to members only.
4.ID and password in using the service will be notified by e-mail. To become a member in the program, you need to get an ID and password with specified settlement.
5.Member has the obligation to manage their ID · password.
6.Any loan, transfer, sale of ID · password are prohibited.
7.The program is not responsible for any loss or damage caused by unauthorized use of your password or ID.

Article 4 (Prohibited matters)

The following acts are prohibited during service.
1.Any violation of intellectual property rights, property, privacy, portrait rights of others.
2.Acts that damage the reputation and credibility to the others
3.Fraud, criminal activity and obstruction of business and acts of trigger these crimes.
4.An act of pretending to be someone else using the service
5.Acts to impair the operation of this program and acts that may impairs this program.
6.Knowing that the act of the aforementioned prohibited acts, encourage these acts.
7.In addition, acts which are judged by the program as violation of public orders, violation of duty and severe violation of the rights of others.

Article 5 (Suspension and cancellation)

Service will be suspended or cancelled if the member has the following acts.
・People under 18-year old.
・It is a false application
・There is a mistake or an omission in registration
・The member’s registration was canceled before
・Acts judged as violation of the Article 4 (prohibited acts)
・In addition, acts judged as inappropriate by the program.

Article 6 (Price)

Member must pay the fare listed on web page to use the service (except for some free services).
1.The program is authorized to change its content of price and terms of service without consent of the members’ due to operation.
2.Fees paid in using the service can not be refund for any reason.
3.Any claim of refund or compensation for interrupt or stop of the service will not be processed.
4.Suspended/cancelled member can not claim for cancellation fee reduction, or refund. The refund or compensation request will not be processed.
5.Reduction or refund can not be processed due to problems caused by user’s PC or broadband service. The refund or compensation request will not be processed.
6.The program is authorized to suspend or cancel service or even claim warranty for damages if any impropriate operation fund.

Article 7 (Escape Clause)

1.This program is not responsible for any problem caused by equipment failure, an over-loaded line, power shortages or power failure, natural disaster, incident, accident and fire, etc. or any stop of service due to irresistible force.
2.This program is not responsible for any damage caused directly or indirectly by members and third parties.
3.The program will respond as quickly as possible if any service problem happened, yet does not guarantee for the time the revering takes.
4.This program is not responsible for any trouble in other sites caused by member for any impropriate operation in accessing other site through our site.

Article 8 (Copy rights and Portrait rights)

Characters, images, videos, texts and all Copy rights and Portrait rights of photos, videos in other forms provided in this program are in the charge of this program and the providing company. Any Reproduction, copying, broadcasting, public transmission, sale, rent, share files, post to bulletin boards are prohibited.
If the portrait rights of copyright violation are discovered, compensation for damages will be claimed immediately. The user can not escape from taking responsibility for compensation for damages of violating Copy rights and Portrait right, even if the user has already been in suspension or has cancelled service.

Article 9 (Stop of service)

The program is authorized to interrupt or stop service without the consent of members’ and without being asked any reasons. This program is not responsible for any damages caused the stop or service.

Article 10 (Damage compensation and Damage warranty)

1.This program does not guarantee for any disadvantage or damage caused by user’s operation. Problems caused directly or indirectly by user and third parties should be solved by the user themselves.
2.This program will claim for compensation for damages or detriments caused by user without hesitation, if the damage occurred to the program. The user can not escape from taking responsibility of compensation even if the user has already been in suspension or has cancelled service.

Article 11 (Validation of the Terms of Service)

1.Terms of Service on this program are always available during this program being used.
2.Copyright portrait rights do not extinct even after service finished. Unsubscribed user must still observe the Article 8.
